Welcome to Somnium (sleepdream.co). These Terms of Service govern your use of our website, application, and services. By accessing or using Somnium, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our service.

1. Acceptance of Terms

By using Somnium, you acknowledge that you have read, understood, and agree to be bound by all provisions of these Terms of Service. Your use of the service constitutes your legal agreement to these terms in their entirety. If you are using Somnium on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms. You further acknowledge that these terms may be updated from time to time, and your continued use of the service following any such updates constitutes your acceptance of the revised terms.

2. Description of Service

Somnium is a digital platform designed to provide sleep tracking, dream analysis, personalized sleep recommendations, and entertainment content related to sleep and dreaming. The service includes access to our mobile and web applications, interactive features, educational content, and community features. Somnium uses algorithms and data analysis to generate insights about your sleep patterns and dreams based on information you provide to the platform.

The service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any aspect of Somnium at any time, with or without notice. We also reserve the right to remove content, restrict access, or terminate user accounts that violate these terms or our community guidelines.

3. User Accounts

To access certain features of Somnium, you must create a user account. You agree to provide accurate, current, and complete information during the registration process and to maintain the accuracy of such information. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.

You agree not to share your account credentials with third parties and to immediately notify Somnium of any unauthorized access or use of your account. You are solely responsible for all actions taken through your account, whether authorized or unauthorized. Somnium is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

You warrant that you are at least 18 years of age or the legal age of majority in your jurisdiction. Users under 18 may use Somnium only with the consent and supervision of a parent or legal guardian. By creating an account, you represent and warrant that all information provided is truthful and accurate.

4. Payment Terms

Subscription Pricing

Somnium offers a subscription plan at $9.00 USD per month. Some features of the service may be available for free, while others require an active subscription. Pricing is subject to change upon thirty (30) days' notice. If you do not cancel your subscription before the price change takes effect, you agree to the new pricing.

Billing

Your subscription will automatically renew each month on the same date your subscription began, unless you cancel before the renewal date. Payment will be charged to the payment method you provide at the time of subscription. You authorize Somnium to charge your payment method for all subscription fees and any additional charges incurred through your account. If your payment method is declined or invalid, we reserve the right to suspend or terminate your account until valid payment information is provided.

All payments are nonrefundable except as provided in this section or as required by applicable law. Sales tax or other applicable taxes will be added to your billing amount as required by law. You are responsible for all applicable taxes related to your subscription.

Cancellation Policy

You may cancel your Somnium subscription at any time through your account settings or by contacting our customer support team at support@sleepdream.co. Cancellation is effective immediately, and your access to premium features will be terminated at the end of your current billing cycle. If you cancel before the end of a billing period, you will not receive a refund of any portion of the subscription fee paid for that period.

After you cancel your subscription, you will retain access to free features of Somnium, but all premium content and features will become unavailable. Your account data and sleep records will remain stored in your account for thirty (30) days following cancellation, after which time they may be permanently deleted. You may reactivate your subscription at any time by returning to your account and selecting the option to renew your subscription.

Refund Policy

All subscription charges are final and non-refundable except where required by applicable law. However, Somnium will consider refund requests submitted within seven (7) days of the initial charge for your first billing period. Such requests must be submitted to support@sleepdream.co with a detailed explanation. Refunds are granted at Somnium's sole discretion and are not guaranteed.

For subscription renewals and subsequent billing periods, no refunds will be issued except as required by law. If you believe you have been charged in error or if you have a dispute regarding a charge, please contact our customer support team within thirty (30) days of the disputed charge.

If you have a subscription through an app store (such as Apple App Store or Google Play), refunds must be requested through that app store in accordance with their policies. Somnium is not responsible for processing refunds through third-party app stores.

5. Intellectual Property Rights

All content provided on Somnium, including but not limited to text, graphics, logos, images, videos, music, software code, and interactive features, is the exclusive property of Somnium or its content licensors. This content is protected by international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use Somnium solely for your personal, non-commercial purposes.

You agree not to reproduce, distribute, transmit, modify, create derivative works from, publicly display, or publicly perform any content from Somnium without prior written permission. You further agree not to reverse engineer, decompile, disassemble, or attempt to derive the source code of the Somnium application or platform. Any unauthorized use of Somnium's intellectual property is prohibited and may result in civil and criminal liability.

User-Generated Content: If you submit, upload, or post any content to Somnium, including dream descriptions, comments, or other materials, you grant Somnium a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such content for the purposes of operating and improving the service. You represent and warrant that you own or have the right to grant these licenses for any content you submit.

You retain ownership of any original content you create and upload to Somnium. However, by submitting content, you permit Somnium to use that content in accordance with these terms and our privacy policy. You agree that Somnium may display your username or account name in connection with any user-generated content you submit.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Somnium and its owners, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if Somnium has been advised of the possibility of such damages.

Your sole remedy for any dissatisfaction with Somnium shall be to stop using the service. Somnium's total aggregate liability to you for any claim arising out of or relating to these terms or your use of Somnium shall not exceed the total amount you have paid to Somnium in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for consequential or incidental damages, so the above limitation may not apply to you. In such cases, Somnium's liability shall be limited to the fullest extent permitted by law.

7. Disclaimer of Warranties and Entertainment/Informational Purpose

IMPORTANT: SOMNIUM IS PROVIDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY AND IS NOT A MEDICAL SERVICE, MEDICAL DEVICE, OR PROFESSIONAL MEDICAL ADVICE.

Somnium is explicitly designed as an entertainment and informational platform. The sleep tracking, dream analysis, insights, recommendations, and all other content provided by Somnium are for entertainment and general informational purposes only. Somnium does not provide medical diagnosis, treatment, cures, mitigation, or prevention of any medical condition or disease.

The algorithms, data analysis, and personalized recommendations provided by Somnium are not medically validated and should not be considered professional medical advice. You acknowledge and agree that Somnium is not a substitute for professional medical consultation, diagnosis, or treatment.

If you have concerns about your sleep, have been diagnosed with a sleep disorder, or are experiencing symptoms that affect your health, you must consult with a qualified healthcare professional, physician, sleep specialist, or other licensed medical provider. Do not rely on Somnium to diagnose, treat, or manage any medical condition.

Somnium provides analytics and insights based on data that you voluntarily input into the platform. The accuracy of these insights depends on the accuracy and completeness of the information you provide. We make no guarantee regarding the accuracy, completeness, or reliability of any analysis, insights, or recommendations generated by Somnium. Sleep patterns and dream experiences vary widely among individuals, and insights that apply to one person may not apply to another.

SOMNIUM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Somnium does not warrant that the service will be uninterrupted, secure, error-free, or that any defects will be corrected. We do not warrant the accuracy, completeness, timeliness, or reliability of any content, information, or recommendations provided through Somnium.

You use Somnium entirely at your own risk. Somnium shall not be liable for any health consequences, medical conditions, injuries, or damages arising from your use of the platform or reliance upon any content provided therein. You assume all responsibility and risk for your decisions and actions based on information from Somnium.

If you experience severe sleep disturbances, persistent nightmares, sleep paralysis, or any other concerning sleep-related symptoms, discontinue use of Somnium and seek immediate medical attention from a qualified healthcare provider.

8. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these terms or your use of Somnium shall be brought exclusively in the federal or state courts located in the jurisdiction where Somnium is headquartered, and you agree to submit to the exclusive jurisdiction and venue of such courts.

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

9. Changes to Terms of Service

Somnium reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the Somnium website or application.
